Court throws out Onamade’s suit challenging AMA House of Assembly primary election

Federal High Court sitting in Lagos has affirmed Abiodun Moshood Aro, popularly known as AMA, as the candidate of the All Progressives Congress (APC) for the Lagos State House of Assembly seat in Ikorodu Constituency II for the 2023 elections.

A contender for the ticket, Oluwatosin Onamade, had filed a suit against the APC, the Independent National Electoral Commission (INEC) and Aro, asking the court to nullify the candidacy of the candidate.

But  the court held that the suit was statute barred because it was filed outside the time frame stipulated by section 285 (9) of the 1999 Constitution of the Federal Republic of Nigeria.

The court also ruled that Onamade failed to establish his claims that the primary election conducted by the APC on May, 27, 2022 wasn’t done in accordance with the provisions of the Electoral Act 2022.

It, therefore, dismissed the plaintiff’s claim in its entirety, and also slammed a fine of N50,000 against Onamade.

It would be recalled that AMA, who is the preferred candidate of Ijede LCDA, had won the APC primary, ending the third term bid of the incumbent lawmaker, Hon. Nurudeen Saka Solaja.
